Platform Boundaries
Official statement regarding platform status, nature of services provided, and liability separation between the Provider and the User.
1. Who We Are (Identity)
SmmPanelUS is a technical IT infrastructure provider.
We develop and maintain software for digital request routing (API Gateway). Our role is strictly limited to providing access to marketing automation tools.
2. Scope of Services
- Provision of software tools for API automation.
- Routing of traffic and requests to social networks.
- Technical support for resellers and agencies.
- Aggregation of statistics and execution metrics.
Not a Bank
We are not a financial institution, bank, or payment processor. Site balance represents internal utility tokens for software services, not a bank deposit.
Not an Ad Agency
We do not create content, configure targeting, or guarantee sales. We provide the "pipe" (infrastructure) for your traffic but do not manage it.
Not a Publisher
We are not responsible for content promoted via our platform. Link moderation is the sole responsibility of the user.
Technical Consulting & Setup
SmmPanelUS may provide services for the technical configuration of marketing tools (ad cabinet setup, campaign configuration, optimization). These services are classified as technical software support and do not constitute full-service advertising agency activities.
We do not manage client ad budgets, own their accounts, or bear responsibility for commercial performance (ROI/KPI). All financial operations, creative assets, and strategic decisions remain the sole responsibility of the client.
4. User Responsibility
By using the SmmPanelUS platform, you (the User) acknowledge and warrant that:
- Your actions do not violate the laws of your country of residence.
- You do not use the platform to promote prohibited materials, fraud, or phishing.
- You understand the risks of interacting with third-party platforms (Instagram, TikTok, etc.) and accept their Terms of Service.
- You bear full financial responsibility for all operations conducted from your account.
5. Service-Level Courtesy Guarantees
Service-Level Courtesy Guarantees represent a voluntary service policy. They are not contractual obligations, warranties, or legally enforceable guarantees. Any courtesy action (refunds, credits, reprocessing) is provided solely at the platform’s discretion and does not override the Terms of Service.
If a service execution is materially disrupted due to internal technical malfunction, the platform may, at its discretion, offer a courtesy reprocessing or service credit.
In case of incomplete delivery caused by internal system errors, we may apply a proportional service-level adjustment or account credit as a courtesy measure.
Estimated processing times are indicative only. However, in case of significant deviations caused by platform-side issues, a discretionary service credit may be considered.
Account balance adjustments performed as part of a courtesy resolution do not constitute refunds, financial guarantees, or monetary compensation.
- Third-party platform actions (blocks, bans, content removal).
- Algorithmic changes of social networks.
- User configuration errors.
- Force majeure or external provider failures.
Liability Boundary
SmmPanelUS provides services "as is", without warranties of any kind, whether express or implied. We do not guarantee the continuous operation of third-party APIs (social networks) and are not liable for bans, shadowbans, or content removal on third-party resources. The use of automation tools is at your own risk.
